"Legally valid" marriage in both countries
3 Additional Requirements to Satisfy
1. Credibility of Marriage
It must NOT be a "sham marriage."
- How you met, courtship story, introductions to family
- Cohabitation (living apart is a red flag)
- Dating records (photos, LINE messages, etc.)
2. Stability and Continuity
Financial capability and communication ability.
3. Good Conduct
No issues with past immigration history.
If there are overstays or non-status activity violations, approval may be denied.
*If violations exist, a letter of reflection may be needed.
To obtain a spouse visa, simply being married is not enough. As a prerequisite, a "legally valid marriage in both countries" must be established, proven through family register and marriage certificate.
In addition, the following 3 important criteria must be met.
1. Credibility of the Marriage
Essentially, this means proving it is NOT a "sham marriage."
What must be proven:
- How you met and your courtship story
- Relationship with each other's families
- Reality of married life including cohabitation
In particular, "cohabitation" is crucial. Unless there is a very good reason, approval is difficult if you plan to live separately.
Also, a large age gap or short dating period requires more thorough evidence.
2. Ability to Sustain a Stable Married Life
"Financial capability" to live stably in Japan and "communication ability" between spouses are examined.
3. Good Conduct
For those already in Japan applying for a change, their immigration history to date is reviewed.
- Any overstays?
- Compliance with part-time work hour limits?
- Any other immigration law violations?
*If there are unavoidable circumstances, approval may still be possible with a statement of explanation and letter of reflection.
Summary
Logically proving these 3 requirements to Immigration through your "Statement of Reasons" and "Supporting Documents" is the shortest path to approval.
