[Essential Knowledge] The Difference Between a "Residence Card" and a "Passport" -- What Happens When They Expire?

Residence Card vs Passport

Dealing with an Expired Passport
for Foreign Employees

Conclusion: Not Immediately Illegal, but Renewal Applications Will Be Blocked!

An expired passport does not make someone an overstayer as long as the "Residence Card" is still valid.
However, it means they cannot renew their residence status or travel abroad, so prompt action is needed.

Passport

  • Issued by: Home country government
  • Role: Proof of nationality & identity (ID)
  • *Renewed at: Embassy/consulate of home country in Japan

Residence Card

  • Issued by: Japan's Ministry of Justice (Immigration)
  • Role: Permit to stay in Japan
  • *If this is valid, the stay is legal

2 Major Risks of an Expired Passport

1

Cannot Travel Abroad

Temporary visits home and business trips overseas become impossible.

2

Cannot Renew or Change Residence Status

A "valid passport" is required for all applications to Immigration. This is the biggest pitfall.

How Your Company Can Help

Expiry Tracking
Include passport expiry dates in HR records
Reminders

"While reviewing HR files, I noticed that our foreign employee Mr. A's passport expired last month!"

Hello! I'm Shizuka Wakabayashi, a certified Immigration Specialist.
In this article, I explain the legal differences between the "Residence Card" and "Passport," and the problems that arise when a passport expires.

[Key Principle] The "Residence Card" and "Passport" Are Separate Documents

It is important to understand the different roles of these two documents.

Passport

  • Issued by: Home country government
  • Role: Internationally recognized ID proving "nationality" and "identity"

Residence Card

  • Issued by: Japan's Ministry of Justice (Immigration Services Agency)
  • Role: Proof of permission for mid- to long-term residence in Japan

The legality of your stay in Japan is determined by the "expiration date of residence period" stated on the Residence Card. An expired passport alone does not make you an overstayer.

Why Is a Valid Passport Necessary?

Problem 1: Cannot Leave or Re-enter Japan

An expired passport will not be accepted at immigration inspection for departure or arrival.

Problem 2: Major Obstacle to Renewing or Changing Residence Status [Critical]

A "valid passport" is required for all applications to Immigration. Whether at the counter or online, applications will not be accepted without a valid passport.

Without a valid passport, you cannot renew your residence status, and you will eventually lose it altogether.

The Correct Procedure: Renew at Your Embassy or Consulate

Passport renewal is done at the embassy or consulate of your home country located in Japan. Depending on the country, it may take several weeks to several months.

How Your Company Can Help

The most effective support is "prevention."

  • Expiry TrackingInclude passport expiry dates in your HR data management.
  • Advance RemindersGive a heads-up 6 months to 1 year before expiration: "It's time to start the renewal process."
  • Leave AccommodationEmbassies are generally open only on weekdays. Make it easy for employees to take leave for visits.

It is essential that both the Residence Card and passport remain valid at all times. Supporting the management of both expiry dates is what true employee retention support looks like.
